Terms and Conditions

These Terms and Conditions govern your access to and use of Bookky’s online booking platform and related services. By using Bookky, you agree to comply with and be bound by these Terms. If you do not agree, please do not use the services.

1. Introduction and Scope

Bookky is an online platform that helps businesses to manage their service bookings/appointments. These Terms apply to all users of Bookky services, including customers of the businesses.

By using the services, you agree to these Terms and our Privacy Policy.

2. Service and Description

Bookky provides a platform for businesses to manage bookings/appointments. The services include, but are not limited to, online booking management, customisable booking page, schedule management, email notification, booking insight reports.

Permitted Use:

You may use the services solely for lawful business purposes. You agree not to:

  • Engage in any activity that violates applicable laws or regulations;
  • Interfere with the operation, security, or integrity of the services;
  • Access data not intended for you or use another user’s account without authorization.

3. Payment and Pricing

Free Trial:

New users are currently entitled to a complimentary 30-day free trial. After the trial period, continued access to Bookky features will require a paid subscription. The trial period is subject to change at Bookky’s discretion.

Subscription Fees:

Current pricing is 21.99 AUD per month per business location and it may be updated periodically. Subscription fees are charged in advance and are non-refundable.

Payment Terms:

Bookky partner with Stripe to secure payments and transactions. Payments must be made using one of the accepted methods listed in app. After free trial period, failed payment will result in losing access to all Bookky features.

Refunds:

During free trail period, Bookky users are free to use all bookky features and test if Bookky fits for purposes with no cost. After free trial when payment for a period is made, except where required by law, Bookky does not provide refunds for unused subscription periods. For cancellations, the subscription will remain active until the end of the current billing cycle, the unused period is not refundable.

4. Warranties and Disclaimers

Limited Warranty:

Bookky strives to provide fast, reliable and secure services. However, we do not warrant that the platform will be uninterrupted, error-free, or completely secure.

Disclaimer:

To the maximum extent permitted by law, Bookky disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. The services are provided “as is” and “as available.”

5. Liability and Indemnity

Limitation of Liability:

To the extent permitted by law, Bookky is not liable for any indirect, incidental, consequential, special, or exemplary damages, including but not limited to loss of profits, goodwill, or data arising from your use of our services.

Indemnification:

You agree to indemnify, defend, and hold harmless Bookky and its directors, officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the services, your breach of these Terms, or your violation of any applicable law or the rights of a third party.

6. Intellectual Property

Ownership:

All content, trademarks, logos, software, and other intellectual property associated with Bookky are the exclusive property of Bookky or its licensors. No rights are granted except as expressly provided in these Terms.

User Content:

You retain ownership of any content you upload or submit via the platform. By doing so, you grant Bookky a non-exclusive, royalty-free license to use, host, and display such content solely for the purpose of delivering the services.

7. Governing Law and Dispute Resolution

Governing Law:

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia. Each party irrevocably and unconditionally submits to the exclusive jurisdiction of the courts operating in New South Wales, Australia and any courts entitled to hear appeals from those courts and waives any right to object to proceedings being brought in those courts.

Dispute Resolution:

Before initiating any formal proceedings, parties agree to attempt to resolve disputes informally. If resolution cannot be reached, the dispute shall be resolved through mediation or arbitration as a condition precedent to litigation, where permitted by law.

8. Termination

Termination by User:

You may terminate Bookky account at any time by cancelling the subscription in app, or contact us at bookky.business@gmail.com and provide us your Bookky username to be terminated.

Termination by Bookky:

Bookky reserves the right to suspend or terminate your access to the services at its sole discretion, with or without notice, in cases of suspected fraud, abuse, violation of these Terms, or any activity that may harm the integrity of the platform.

9. Miscellaneous

Modifications to Terms:

We may revise these Terms from time to time. Material changes will be updated on this page. Continued use of the services after such updates constitutes your acceptance of the revised Terms.

Severability:

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement:

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Bookky regarding the use of our services.
